Terms and conditions

These terms govern your use of outdoorsports.irish and any purchase you make from Outdoor Sports Company, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). Please read them before you go further. By accessing, browsing or otherwise using the site, you agree to these terms.

You also agree to follow any rules, guidelines and policies that apply to a particular service before you use it. We may change the site and these terms at any time. The version on this page when you place an order is the one that applies to that order.

Using the site

You must not upload, share or publish anything through this site that:

• contains bugs, viruses, worms, trap doors, Trojan horses or any other harmful code;
• is libellous, threatening, defamatory, obscene, indecent, pornographic or discriminatory, or could give rise to civil or criminal liability under the laws of Ireland or of any other country that may apply;
• breaches anyone's copyright, patents, trade marks, service marks, trade secrets or other rights.

You must also not try to get unauthorised access to our systems, interfere with how the site works or its security, give false information, or pretend to be someone else.

Age

By using this site you confirm that you are 18 or over. If you are under 18, please use the site only with the supervision of a parent or legal guardian.

Your licence to use the site

Subject to these terms, we give you a limited, revocable, non-transferable and non-exclusive licence to view the site in your browser for the purpose of shopping. This does not cover commercial use or use on behalf of a third party, unless we have agreed to it in advance. If you breach these terms, this licence ends straight away without notice.

Our content

Everything on this site, including images, text, illustrations, designs, icons, photographs, programs, video and other material (the "Contents"), belongs to us or our licensors. Unless we have agreed otherwise in advance, the Contents are for your personal, non-commercial use only.

You may not make commercial use of the information on the site, or use the site for the benefit of another business. You may not copy, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit the site or any part of it, unless we have agreed to it in writing.

Buying for a club, school or organisation is welcome. For bulk orders, please use our wholesale quote form.

Accounts and passwords

You can shop on this site without an account. If we ever give you a login or password for part of the site:

• each use of it is treated as authorised by you, and we have no duty to check who is using it;
• you are responsible for all use of the site made with it, whether or not you authorised that use, including any orders or payments made;
• you must keep it secure and confidential, and tell us straight away about any unauthorised use of it or any breach of the site's security.

Products and descriptions

We take care to describe our products accurately, including sizes, materials and specifications. Photos are for illustration, and colour and finish can vary slightly between production batches. Please check sizes, weight ratings and space needs before you order. Our disclaimer covers product use and suitability.

Prices

All prices are in euro (€). We work to keep prices correct. If we find an error in the price of an order you have placed, we will contact you before dispatch to ask whether you want to go ahead at the correct price, or cancel with a full refund.

If you have a discount code, enter it in the cart before checkout.

Orders

• Placing an order is an offer to buy. A contract is formed once we confirm and dispatch your order.
• We may refuse service or cancel an order, for example where stock is not available, where we suspect fraud, or where we believe a customer's conduct breaks the law or harms our business. If we cancel an order you have paid for, we refund you in full.
• Please give accurate delivery and contact details. We are not responsible for delays or failed deliveries caused by incorrect details.
• Once payment has cleared, orders are usually handled within 24 to 48 hours.

Payment and security

You can pay by card through Stripe, or with PayPal. Payments are taken on their secure, encrypted pages. We never see or store your full card number. Your order is processed once payment is authorised.

Delivery, returns and cancellations

Limitation of liability

To the fullest extent the law allows:

• our total liability arising from an order is limited to the amount you paid for the products in that order;
• we are not liable for indirect or consequential losses, or for loss of profit, data or opportunity;
• we provide the website "as is" and do not promise it will always be available, uninterrupted or free of errors.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law. These terms do not affect your statutory rights as a consumer, including your rights under the Consumer Rights Act 2022. See also our limited liability and indemnity page.

Governing law

These terms are governed by applicable law, and any dispute will be handled under the relevant jurisdiction. If you live in Ireland or elsewhere in the EU, you keep the protection of the mandatory consumer law of the country where you live, and you can bring a claim in the courts there.
