Liability limitation and indemnity

This page sets out the limits of our liability, and your indemnity to us, when you use outdoorsports.irish or buy from Outdoor Sports Company, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It forms part of our terms and conditions.

Your statutory rights come first

Nothing on this page limits or excludes any liability that the law does not allow us to limit or exclude. That includes liability for death or personal injury caused by our negligence, for fraud, and for your rights and remedies under the Irish Consumer Rights Act 2022 and the EU Consumer Rights Directive. Where those rights apply, they take priority over anything below.

Limited liability

Subject to the section above, and to the fullest extent the law allows:

• Where we are liable, our total liability for any claim connected with an order is limited to the amount you paid for the goods that the claim relates to.
• We are not liable to you, or to anyone claiming through you, for indirect, consequential, special or incidental losses, or for loss of profit, revenue, data or goodwill, arising from your use of, or inability to use, a product. This applies whatever the type of claim, even if we were told such a loss was possible.
• We are not liable for loss or damage that was not foreseeable, or that was caused by misuse of a product, poor installation or anchoring, lack of suitable supervision, failure to follow the supplied instructions, or normal wear and tear.
• We are not liable for delays or failures caused by events outside our reasonable control. If we cannot supply a product you have paid for, or a transaction is cancelled, we refund what you paid for it.

Training equipment and injury

Sport carries a risk of injury, and no equipment removes it. Protective items such as neck guards, pads, gloves and mats can reduce some risks, but we do not claim that any product prevents injury or loss unless its product page states a specific, verified safety standard.

You use our products at your own risk, apart from where we are at fault or where the law says otherwise. Except for our own wilful misconduct, fraud or negligence, you are responsible for any damage to you, your property, or anyone else or their property, that arises from how a product is used. Please follow the instructions, check equipment before each session, and make sure children and beginners are properly supervised.

Indemnity

You agree to indemnify us, and our staff, representatives and distributors, against reasonable losses, costs and claims (including legal fees) that we suffer because of your breach of our terms, your misuse of the site or a product, or your breach of someone else's rights through your use of the site. This includes claims for contribution or subrogation, and extends to any third party claiming through you.

Where the site may be used

Our products and site are not intended for distribution to, or use by, any person or organisation in a country where that would break local law or regulation, or would require us or our licensees or affiliates to register there.

The website and third parties

The website and its content are provided "as is". To the extent the law allows, we give no warranties about the website itself, including any implied warranty that the site will suit a particular purpose. This does not affect your statutory rights in the goods you buy.

We are not responsible for fraud, theft, hacking, interception, piracy, misuse, misrepresentation or other unlawful acts of third parties, except where we have failed to take reasonable care.

The information on this website is provided in good faith. We work to keep it accurate and complete, but we cannot promise that it always is. To the extent the law allows, we do not accept responsibility for errors in, or omissions from, the information on the site. See also our disclaimer.

If our website does not comply with the laws of a country, residents of that country should not use it.
